GIPA Act 2009

You have the right to access government information under the Government Information (Public Access) Act 2009. This section shows you how to:

  • Get already available information
  • Request information that's not publicly available

How can I access government information?

The four pathways open to you to access government information are:

1. Mandatory open access

2. Proactive release

3. GIPA informal request

4. GIPA formal request

GIPA formal request

If the information you are looking for is not published by us or available by informal request, you may wish to make a formal access application in writing under the GIPA Act. We will not release information to you if there is an overriding public interest against its disclosure.

You can make a formal application by completing a Government Information Public Access (GIPA) application form.

The GIPA Act says that we are only able to accept access applications that:

  • are in writing and sent to us at the address above
  • indicate clearly that the applicant is making an access application under the Government Information (Public Access) Act 2009 (NSW)
  • pay the $30.00 application fee via EFT payment to Destination NSW’s bank account. Please contact us by emailing legal.procurement@dnsw.com.au for the bank account details or if you are unable to make an EFT payment.
  • state the name of the applicant, and have a return postal or email address as the address for correspondence
  • include as much specific information as reasonably necessary to enable us to identify the information you are asking for.

If your application does not include these five things, it will be invalid and will not be processed. If that happens, we will let you know and we will help you, if possible, by explaining how you can make a valid application.

Otherwise, we will write to you acknowledging receipt of a valid access application within five working days and will deal with your application within 20 working days (subject to any extension allowed for under the Act). If any extension of time is required to deal with your application, we will let you know in writing.

Application fees and processing charges

The application fee for making an access application is $30. Processing charges can also be imposed at the rate of $30 per hour. In some circumstances an advance deposit can be required. We will let you know in writing if that applies to your application. Certain discounts may apply, including on financial hardship and public interest grounds – for more details see the NSW Information and Privacy Commission website.

Disclosure log

A disclosure log is a record containing details of government information already released under the Government Information (Public Access) Act 2009 (GIPA Act). A disclosure log is part of the open access information that agencies are required to make available and is a requirement under Section 25 of the GIPA Act.

Destination NSW has determined that the information referred to in its Disclosure Log (PDF 657 kb) may be of interest to other members of the public.

Please note that the disclosure log lists the information requested at the time and may not be the most up-to-date version of the information.

Contract Register

We must record and publish certain information about contracts entered into with private sector organisations that have a contract value of $150,000 or more.

Details of each contract must be entered into the register within 45 working days of coming into effect, and must remain on the register for 30 days or until the contract is complete, whichever is longer.

Record of Open Access Information not publicly available

The Government Information (Public Access) Act 2009 NSW requires all agencies to make available, free of charge on their websites, their “open access information”.

However, there is an overriding obligation under the Act not to publish any specific “open access information” if there is an overriding public interest against disclosure of that particular information.

Whenever Destination NSW decides that particular “open access information” should not be publicly available, a record of the decision is made.

Destination NSW has not made a decision that there is an overriding public interest against disclosure of any of its open access information. Should such a decision be made it will be recorded here.
